1. Introduction and Acceptance of Terms

Welcome to Leext. These Terms of Use ("Terms"), alongside our Privacy Policy and Cookie Policy, form a binding legal agreement between Leext Software Technology Inc. ("Leext", "we", "us", or "our") and you, the user, whether acting on your own behalf or representing an entity ("User", "you"). By accessing or utilizing the services and platform provided by Leext ("Service"), you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must cease use of the Service immediately.

2. Description of Services

Leext provides a state-of-the-art Software as a Service (SaaS) platform designed to streamline and enhance the recruitment processes for businesses. Our Services include, but are not limited to, candidate assessment tools, job posting functionalities, candidate ranking algorithms, and comprehensive recruitment management systems ("Services"). The Services are subject to ongoing updates and enhancements in pursuit of excellence and user satisfaction.

3. Registration, Account Integrity, and Security

• Registration: Access to certain functionalities of the Service requires you to register for an account. You agree to provide truthful, accurate, and complete information during the registration process and to update such information to maintain its accuracy.

• Account Security: You are responsible for safeguarding the confidentiality of your account credentials. Any unauthorized use of your account or security breach must be immediately reported to Leext.

• Account Use: The account registered on the Leext platform is specific to the company or business entity that created it and cannot be shared with or transferred to another company or entity without the express written consent of Leext. Each account is intended for use by authorized personnel within the registered company, and it is the company's responsibility to manage access and usage within its organization in accordance with these Terms.

  
  

4. User Obligations and Conduct

You shall use the Service solely for your internal business purposes as contemplated by these Terms and shall not: (i) license, sublicense, sell, resell, transfer, assign, distribute or otherwise commercially exploit or make the Service available to any third party in any way; (ii) modify or make derivative works based upon the Service; (iii) create Internet "links" to the Service or "frame" or "mirror" any content on any other server or wireless or Internet-based device; or (iv) reverse engineer or access the Service to (a) build a competitive product or service, (b) build a product using similar ideas, features, functions or graphics of the Service, or (c) copy any ideas, features, functions or graphics of the Service.

5. Compliance with Laws

You shall comply with all applicable local, state, national and foreign laws, treaties, and regulations in connection with your use of the Service, including those related to data privacy, international communications, and the transmission of technical or personal data.

6. Intellectual Property Rights and Data Ownership

Leext's Intellectual Property: All rights, title, and interest in and to the Service and its components, including any and all intellectual property rights, are and shall remain exclusively with Leext and its licensors. This encompasses but is not limited to algorithms, user interfaces, and all software associated with our services.

User Data and Confidentiality:

• Candidate Data: Candidates have control over their personal data shared through the Leext platform. If a candidate chooses not to share their data beyond a single application, Leext respects this choice and will not disseminate the candidate's information to other companies without explicit consent for each separate application or use.

• Company-Specific Data: Companies may upload proprietary or confidential recruitment questions or materials to the Leext dashboard for use within their recruitment processes. Leext acknowledges the confidentiality of such materials and agrees not to share these with any third parties, including other companies using the Leext services. Such company-specific data will be treated as Confidential Information under these Terms.

• Protection of Confidential Information: Both parties commit to protecting the confidentiality of the User Data and any Confidential Information disclosed during the use of the Service. This includes taking reasonable security measures to prevent unauthorized access to or disclosure of such information.

  
  

7. Data Protection and Privacy

• Compliance with Data Protection Laws: Leext is committed to complying with the Personal Data Protection Law No. 6698 ("KVKK") and applicable data protection regulations. We will process personal data provided through the Service in accordance with our Privacy Policy, these Terms, and applicable legal requirements.

• Rights of Data Subjects: Candidates and companies have rights concerning their personal data processed by Leext, including the right to access, correct, and delete their data, as well as the right to restrict processing and object to processing in certain circumstances.

• Data Processing Agreement (DPA): Where applicable, Leext will enter into a Data Processing Agreement with companies using our services that outlines the responsibilities and obligations of both parties in relation to data protection and privacy to ensure compliance with the KVKK and GDPR (where applicable).

  
  

8. Amendments to User Data Preferences

• Modification of Consent: Users, including candidates and companies, may modify their consent regarding data sharing and processing at any time through the Service's dashboard or by contacting Leext directly. Such modifications will take effect immediately and will be reflected in future data processing activities.

• Retention and Deletion of Data: Leext will retain User Data, including candidate information and company-specific questions, in accordance with our Data Retention Policy as outlined in our Privacy Policy. Users may request the deletion of their data in accordance with their rights under the KVKK and GDPR, subject to any legal obligations that may require the retention of certain data.
